RERA Project Registration – Mandatory Registration for Real Estate Projects Under RERA

End-to-End RERA Project Registration for Residential, Commercial, and Mixed-Use Developments

Section 3 of the RERA Act prohibits any promoter from advertising, marketing, booking, selling, or accepting any advance payment from buyers for a qualifying real estate project without first registering it with the state Real Estate Regulatory Authority. The registration application under Section 4 requires comprehensive documentation including title and encumbrance certificates, approved layout and building plans, commencement certificate from the competent authority, carpet area schedule, project completion timeline, details of all approvals obtained, proforma Agreement to Sale, and bank account details for the mandatory 70% escrow account. A complete, accurately prepared application is critical to obtaining registration without objections or delays.

Our project registration team manages the complete end-to-end process for developer clients — from documentation audit and gap-filling through portal submission, query response, and registration certificate download. Post-registration, all registered projects require quarterly progress reporting and are subject to amendment procedures for any changes to the approved plan.

Why Timely RERA Project Registration Matters

  • Legal right to advertise, market, book, and collect buyer advances — no commercial activity in a qualifying project is permitted before registration
  • Institutional funding prerequisite — most project finance lenders and bank construction finance facilities require RERA registration before first disbursement
  • RERA registration certificate is a buyer trust signal — unregistered projects face buyer resistance, agent refusals, and increased complaint risk
  • Registered project portal page provides transparent disclosure — reducing information asymmetry between promoter and buyer
  • Mandatory disclosure of project details protects the promoter from disputes over carpet area, layout, and specifications that are defined at registration
  • Post-registration compliance framework — quarterly updates and annual audits — creates operational discipline that reduces project slippage and financial leakage

Frequently Asked Questions

Which projects are required to be registered under RERA?
Under Section 3, all real estate projects — residential and commercial — where the area of land proposed to be developed exceeds 500 square metres, or the number of apartments proposed to be developed exceeds 8 (in all phases combined), must be registered with the state RERA authority before any advertising, marketing, booking, or collection of money from buyers. Some states specify lower thresholds. Renovation or repair work without re-allotment is exempt.
What documents are required for RERA project registration?
The application under Section 4 requires: promoter entity PAN and identity documents; title documents and encumbrance certificate; approved layout plan and building plans from competent authority; commencement certificate; carpet area schedule for all units; proforma Agreement to Sale; project completion timeline; details of all pending approvals; details of the designated 70% escrow bank account; and a declaration by the promoter. Document requirements vary across state RERA authorities.
What is the timeline for processing a RERA project registration?
The RERA Act requires the state authority to process a complete and valid registration application within 30 days — either granting registration or issuing a refusal with reasons. If the authority fails to process the application within 30 days, the project is deemed registered. In practice, state portals may raise objections requiring document corrections, which reset the timeline. A complete first-time application minimises objections and processing time.
Does each phase of a project need to be registered separately?
Yes. Under RERA, each phase of a real estate project is treated as a separate project for registration purposes and must be registered independently with its own completion timeline, escrow account, and disclosure schedule. This means a large project with three phases requires three RERA registrations. Phase-wise registration enables independent marketing and sale of each phase without cross-contaminating timelines and financial reporting.
Can I sell apartments in a RERA-registered project before all approvals are obtained?
No. A promoter can apply for RERA registration only after obtaining the commencement certificate (or equivalent approval) from the competent authority. Without a commencement certificate, the project registration application is incomplete and cannot be submitted. Some states allow provisional registration for projects where certain approvals are pending — subject to an undertaking that approvals will be obtained by a specified date.
