Is PAN Mandatory for an NRI?

Without a PAN, tax on payments to you is deducted at twenty percent or the applicable rate, whichever is higher — and treaty benefits that would otherwise cut that rate are unavailable. For an NRI selling property or holding Indian deposits, the absence of a ten-digit number can cost more than the tax itself, and none of it is recoverable without filing a return, which also needs the PAN.

📌 PAN Does Not Create Residency PAN is an identification number, not a declaration of residency. Holding a PAN does not make you an Indian tax resident, and it does not create any filing obligation by itself. Non-residents sometimes avoid applying under the impression that it creates exposure — it does not. The Section 206AA rate does.

Who Should Apply for PAN?

NRIs with Indian Income or Investments

Anyone earning rent, interest, dividends or capital gains from India needs PAN both to avoid the higher deduction rate and to reclaim what has been deducted. Without it, TDS is applied at the Section 206AA rate and the return needed to recover the excess cannot be filed.

NRIs Buying or Selling Indian Property

Property transactions require PAN from both parties. For a non-resident seller the amounts at stake are large — the buyer deducts at non-resident rates against the seller's PAN. Applying for a lower deduction certificate also requires PAN, so it should be obtained well before a sale is agreed.

OCI Holders and Foreign Nationals

Foreign citizens, including OCI holders, apply on Form 49AA rather than Form 49A. Documents executed abroad require apostille or consular attestation — this is the step that most commonly delays these applications. Applicants should allow several weeks for that process.

Foreign Companies with Indian Income

A foreign company receiving Indian-source income — royalties, fees for technical services, interest or business income — needs PAN for the same reason an individual does. Where the entity also makes payments requiring TDS deduction in India, TAN registration is a separate requirement, and the two are frequently confused.

How We Obtain PAN for a Non-Resident

  1. Form Determination

    We establish whether Form 49A or Form 49AA applies. Indian citizens — including NRIs holding Indian passports — use Form 49A; foreign citizens, including OCI holders, use Form 49AA. Applying on the wrong form causes rejection rather than correction.

  2. Document Identification

    Proof of identity, proof of address and proof of date of birth are identified according to the applicant category. For foreign citizens this typically means passport, OCI card where held, and overseas address proof such as a bank statement or residence permit.

  3. Attestation and Apostille

    Documents executed outside India require apostille where the country is a party to the Hague Convention, or attestation by the Indian embassy or consulate otherwise. This step takes time and cannot be compressed — it is started early in every engagement.

  4. Address Decision

    We advise whether to use an Indian or overseas communication address. An overseas address is permitted but attracts a higher dispatch fee, and where a reliable Indian address exists it usually simplifies delivery and later correspondence.

  5. Application Preparation and Submission

    The form is completed with the correct status, category and source of income, and submitted with supporting documents and photographs. Consistency of name spelling across passport, documents and the application is checked — mismatches are the leading cause of rejection.

  6. Application Tracking

    The acknowledgement number is tracked through processing and any query from the processing agency is answered promptly with the supporting evidence required.

  7. Allotment and Verification

    On allotment we verify the details on record — name, date of birth, status and address — since errors carried into the database create difficulties later at exactly the wrong moment, typically during a property transaction.

  8. Residential Status Update on Portal

    For non-residents we ensure the status recorded is correct — this is what prevents the PAN being flagged as inoperative for want of Aadhaar linking, which has affected NRI PANs in error.

How the PAN Position Differs by Applicant

NRIs Holding Indian Passports

Indian citizens abroad apply on Form 49A even though resident overseas. Many in this group already hold PAN from before they left India — in which case the requirement is not a fresh application but an update of address and residential status on the record.

Non-Residents with Existing but Inoperative PAN

Where a PAN has been marked inoperative for want of Aadhaar linking despite the holder being a non-resident, the remedy is to have the residential status updated on the department record with supporting evidence of non-residency. This should be addressed as soon as it is noticed, since an inoperative PAN blocks filing, causes higher deduction and stalls refunds.
